Agreement to Terms
By accessing or using Kinfile (“the Service”), operated by Kinfile (“we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
Service Description
Kinfile is a secure digital vault that helps you organize and store important family information — including documents, credentials, contacts, and instructions — and share access with trusted contacts under conditions you control.
Eligibility
You must be at least 18 years old to use Kinfile. By using the Service, you represent that you meet this requirement and that all information you provide is accurate.
Account Security
You are responsible for maintaining the security of your account credentials. You agree to:
- Use a strong, unique password for your Kinfile account.
- Enable two-factor authentication when available.
- Notify us immediately if you suspect unauthorized access to your account.
- Not share your login credentials with others. Use the sharing and emergency access features instead.
We are not liable for any loss resulting from unauthorized use of your account.
Subscription Terms
Plans and pricing
Kinfile offers the following subscription plans:
- Basic ($199/year) — 1 vault, emergency access.
- Core ($299/year) — 2 vaults, shared vault, granular sharing.
- Family+ ($599/year) — Up to 6 vaults, per-member visibility, AI onboarding included.
- AI Onboarding ($49 one-time) — Available as an add-on for Basic and Core plans.
Prices are in USD and may be updated with 30 days' notice.
Billing and renewal
Subscriptions are billed annually through Stripe and renew automatically. You can cancel at any time from your account settings. Cancellation takes effect at the end of your current billing period.
Grace period
If your subscription lapses (payment failure or cancellation), a 21-day grace period begins. During this period:
- Day 0: You are notified of the lapse.
- Day 7: Second notification sent.
- Day 14: Final warning sent.
- Day 18: All household members notified.
- Day 21: Your vault is quarantined (read-only). You can still export your data.
After quarantine, data is retained for 90 days. You can resubscribe at any time during this period to restore full access.
Refunds
We offer a 60-day money-back guarantee for new subscribers. If you are not satisfied, contact us within 60 days of your first payment for a full refund. After 60 days, refunds are not available, but you may cancel at any time.
Acceptable Use
You agree not to use Kinfile to:
- Store content that is illegal, fraudulent, or violates the rights of others.
- Upload malware, viruses, or other malicious files.
- Attempt to gain unauthorized access to other users' accounts or data.
- Use the Service to harass, threaten, or impersonate others.
- Reverse-engineer, decompile, or attempt to extract the source code of the Service.
- Use automated systems (bots, scrapers) to access the Service without our written permission.
We reserve the right to suspend or terminate accounts that violate these terms.
Emergency Access
Kinfile provides an emergency access feature that allows designated trusted contacts to request access to your vault. By configuring emergency access, you agree to the following:
- When a trusted contact requests emergency access, you will be notified immediately by email.
- You may approve or deny the request at any time during the wait period you configured (between 1 and 14 days, default 3 days).
- If you do not respond within the wait period, access is granted automatically. This is a core design feature, not a malfunction.
- It is your responsibility to configure the wait period and trusted contacts appropriately.
Kinfile is not liable for any consequences arising from emergency access being granted, whether approved by you or auto-approved after the wait period expires.
Shared Vault & Households
- Household vaults are managed by a single billing owner who is responsible for the subscription.
- The billing owner controls member access and can set permission scopes (all items, specific categories, or specific items).
- Member limits are determined by your plan tier. Adding members beyond your plan limit requires an upgrade.
- If the billing owner's subscription lapses, all household members are affected by the grace period and quarantine process.
Intellectual Property & Data Ownership
Your data is yours. You retain full ownership of all content you upload or store in Kinfile. We do not claim any intellectual property rights over your vault data.
You grant us a limited license to store, process, and transmit your data solely for the purpose of providing the Service to you and your designated contacts.
The Kinfile name, logo, software, and website design are our intellectual property and may not be used without our written permission.
Limitation of Liability
To the maximum extent permitted by law, Kinfile and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or loss of business opportunities, arising out of or related to your use of the Service.
Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid to Kinfile in the 12 months preceding the claim.
Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or completely secure. While we implement strong encryption and security measures, no system is 100% immune to breaches.
Kinfile is not a legal, financial, or estate-planning service. The information stored in your vault does not constitute legal advice. We recommend consulting qualified professionals for estate planning, legal, and financial matters.
Indemnification
You agree to indemnify, defend, and hold harmless Kinfile and its officers, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
Termination
You may close your account at any time by contacting us. We may suspend or terminate your access to the Service if you violate these Terms, engage in abusive behavior, or fail to maintain an active subscription beyond the grace and retention periods.
Upon termination, your right to use the Service ceases immediately. Data retention following termination is governed by our Privacy Policy.
Dispute Resolution
If you have a dispute with Kinfile, we encourage you to contact us first at support@kinfile.com so we can try to resolve it informally.
These Terms are governed by the laws of the State of New York, United States, without regard to conflict of law provisions. Any disputes not resolved informally shall be resolved in the courts located in New York County, New York.
Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on our website at least 30 days before the changes take effect. Your continued use of Kinfile after the effective date constitutes acceptance of the updated Terms.
